TERMS & CONDITIONS

1. General information

Dive with Eva is legally represented by Eva Lenain, SSI instructor.
The use of the divewitheva.com website and the booking of our services are governed by the present General Conditions (“GC”) in accordance with the Mexican General Tourism Law and the NOM-05-TUR-2003 standard for dive operators.

2. Services on offer

• Recreational diving courses (Open Water, Advanced, Rescue and specializations) ;
• Guided tours of the cenotes and the Caribbean Sea ;
• Equipment rental.

All activities are carried out in compliance with the safety requirements of NOM-05-TUR-2003.

3. Booking process

The customer sends a request by WhatsApp or e-mail, we confirm availability and conditions, and then send a secure payment link for the 30% deposit.
On receipt of the deposit, we send a confirmation by WhatsApp; the contract is then deemed concluded.

Important: the site does not process or store credit card details; payment is made via the external link provided.

4. Rates and payment terms

• Prices in MXN, VAT included unless otherwise stated;
• Deposit via the payment link; balance to be paid in cash or by card (5% fee) on the day of the dive ;
• Tax invoices available on request.

5. Modifications and cancellations

• ≥ 2 weeks before activity: 100% refund less cancellation fee of 200mxn/ per;
• < 2 weeks or absence: non-refundable deposit.

If the activity is cancelled due to weather, port closure or force majeure, the customer may reschedule free of charge or receive a full refund.

6. Conditions of participation

Minimum age: 8 years. Some courses or sites require prior certification or a higher minimum age.
Customers must sign a waiver and present their certification and a medical certificate of fitness, if applicable.

7. Risk acceptance

The customer acknowledges the risks inherent in diving and releases Dive with Eva from any liability beyond the insurance coverage and within the limits provided by the Mexican Federal Civil Code.

8. User conduct

We reserve the right to refuse service, without refund, to anyone under the influence of alcohol or drugs, using defective equipment or failing to comply with safety instructions.

9. Intellectual property

All content on this site is owned or licensed by Dive with Eva and may not be reproduced without prior written permission.

10. External links

The site may contain links to third-party sites (payment platforms, social networks).
We do not guarantee their availability or content.

11. Legislation and jurisdiction

These GTC are governed by the laws of the United Mexican States.
Any dispute shall be submitted to the competent courts of Tulum, without prejudice to prior mediation before PROFECO.

12. Updates

Any modification will be published with its effective date; continued use of the site constitutes acceptance of the new version.
